Terms and Conditions

These terms and con­di­tions define the rights and oblig­a­tions of you as a cus­tomer of Cat­sand­ber­ries.

Communication with customers

You are wel­come to ask ques­tions con­cern­ing deliv­ery, pay­ment and prod­ucts offered for sale.
If you have ques­tions about gar­den­ing or cat­proof gar­dens, you may even­tu­al­ly find the answers in the Arti­cles.
If you have any doubts about your rights or oblig­a­tions, ques­tions about your order or deliv­ery, or any com­ments regard­ing this text, please don’t hes­i­tate to con­tact us.
We assume that through mutu­al dis­cus­sion, every­thing can be addressed and resolved.
Cat­sand­ber­ries always strives to answer your e‑mails in a time­ly man­ner.

Prices

The price indi­cat­ed on the prod­uct sheets does not include ship­ping costs and tax­es.
The price indi­cat­ed in the order con­fir­ma­tion at the bot­tom of the page under the head­ing “Total to be paid” is the final price inclu­sive of ship­ping costs.
Cat­sand­ber­ries reserves the right to mod­i­fy its prices.
The plants and prod­ucts will be invoiced on the basis of the price at the time of the val­i­da­tion of the order and sub­ject to avail­abil­i­ty.

Availability

Cat­sand­ber­ries doesn’t sell prod­ucts in large quan­ti­ties.
There­fore, stock is lim­it­ed. Pre-orders are not pos­si­ble.
The prod­ucts are offered as long as they are vis­i­ble on the web­site and with­in the lim­its of the avail­able stock.
If after plac­ing an order an ordered prod­uct (prod­ucts) turns out to be out of stock, you will be informed as soon as pos­si­ble by e‑mail to offer either:

  • replac­ing the miss­ing prod­uct with a prod­uct of equiv­a­lent price;
  • mod­i­fy­ing the amount of the order placed, by deduct­ing the amount of the miss­ing product(s) from the total, and reim­burs­ing it to your bank deb­it with­in 5 work­ing days;
  • can­celling the whole order and a refund with­in 5 work­ing days.

Minimum order value

The min­i­mum order val­ue for goods to be shipped is 50 euro exclud­ing ship­ping costs.

Value Added Tax (VAT)

Cat­sand­ber­ries does not charge VAT. It ben­e­fits form the spe­cial (EU) exemp­tion for small enter­pris­es (the SME scheme). Hence, Cat­sand­ber­ries, as a rule, only sell to pri­vate cus­tomers.

Shipping costs

Ship­ping costs include trans­port costs, the costs of the han­dling, the pack­ag­ing and the pro­tec­tion of the prod­ucts. The ship­ping costs are based on the weight of the ordered plants and are auto­mat­i­cal­ly cal­cu­lat­ed at check-out.
Cat­sand­ber­ries reserves the rights of choos­ing a ship­ping provider. In most cas­es it will be Bpost or PostNL.
Cat­sand­ber­ries deliv­ers to the fol­low­ing coun­tries:
Bel­gium – 14,50 euro (up to 10 kg).
Nether­lands, Lux­em­burg, France, Ger­many – 22,50 euro (up to 10 kg)
You will be pro­vid­ed with the track and trace link.

Validating order and payment

Once the order process has been com­plet­ed, “plac­ing your order” indi­cates full accep­tance of the order and the Terms and Con­di­tions with­out any reser­va­tions.
Con­firm­ing the order implies that you are oblig­ed to pay the price indi­cat­ed.
Pay­ment should be made by bank trans­fer on the day of the order.
Cat­sand­ber­ries con­firms accep­tance of the order to the cus­tomer at the e‑mail address pro­vid­ed.
The prod­ucts remain the prop­er­ty of Cat­sand­ber­ries until the order has been con­firmed and the pay­ment is received.

Cancellation

Cat­sand­ber­ries reserve the right to can­cel any order for any rea­son what­so­ev­er as well as to can­cel a con­firmed and paid order with an oblig­a­tion to refund the whole sum with­in 5 work­ing days.
You have the right to can­cel the order before it is dis­patched. In case of can­cel­la­tion, you get a refund with­in 5 work­ing days.

Dispatch and delivery time

The plants and prod­ucts will be pre­pared for ship­ment nor­mal­ly with­in 1–5 work­ing days after receiv­ing the order pay­ment.
Plants can be trimmed to lim­it the risk of break­age dur­ing trans­port.
Deliv­ery takes usu­al­ly 1–5 work­ing days depend­ing on the des­ti­na­tion.
Cat­sand­ber­ries has the right to delay a dis­patch of your par­cel because of unfa­vor­able weath­er con­di­tions (tem­per­a­tures below zero or high­er than 25°C can harm plants dur­ing trans­port) or unfore­seen events, like postal strikes, for exam­ple.
In case of pos­si­ble delay, you will be informed by e‑mail.

Delivery

The plants and prod­ucts are deliv­ered to the deliv­ery address indi­cat­ed dur­ing the order­ing process.
Any delays do not enti­tle the cus­tomer to claim dam­ages.
War, riots, fire, strikes, acci­dents, floods, storms, frost, heat­waves and the impos­si­bil­i­ty of obtain­ing sup­plies are con­sid­ered to be cas­es of force majeure which relieve Cat­sand­ber­ries of his oblig­a­tion to deliv­er.
Cat­sand­ber­ries can­not be held respon­si­ble for late deliv­ery due exclu­sive­ly to your unavail­abil­i­ty after sev­er­al pro­posed appoint­ments.
In the event of absence, a deliv­ery notice will be deliv­ered to your let­ter­box, indi­cat­ing where you will be able to pick up the par­cel.
In the event of an incom­plete address, wrong address, refusal of the par­cel by you or lack of infor­ma­tion lead­ing to the impos­si­bil­i­ty of deliv­er­ing the prod­uct in time, Cat­sand­ber­ries can­not be held respon­si­ble for the final qual­i­ty of this deliv­ery.
If this lack of infor­ma­tion leads to a sec­ond pre­sen­ta­tion, Cat­sand­ber­ries may ask you for the costs cor­re­spond­ing to this sec­ond deliv­ery.

Possible damage during transport

Any com­plaint con­cern­ing the con­di­tion of the prod­ucts and pack­ag­ing must be noti­fied to the ship­ping provider itself on the deliv­ery slip and must be com­mu­ni­cat­ed to Cat­sand­ber­ries with­in 48 hours of receipt of the prod­ucts.
You have to send Cat­sand­ber­ries by e‑mail your com­plaint, the details of the order, as well as pho­tos of the dam­aged prod­ucts and pack­age.

Returns and reimbursements

You can return your prod­ucts with­in 14 days of receipt of the items.
Prod­ucts must be returned using the same mode of trans­port and the same ship­ping provider as that used for deliv­ery.
The prod­ucts must be sent back and intact in their orig­i­nal pack­ag­ing.
This implies that the plants have not been removed from their pots and that their roots, leaves and branch­es are intact.
Also, a prod­ucts can­not be returned incom­plete.
You have to pay the return trans­porta­tion costs.
They won’t be refund­ed.
Your request for reim­burse­ment of the pur­chase price will only be con­sid­ered once the returned prod­ucts have arrived at Cat­sand­ber­ries and are in good con­di­tion.
If one plant or sev­er­al plants arrive in bad con­di­tion, Cat­sand­ber­ries doesn’t refund the plant(s).
Reim­burse­ment is due with­in a max­i­mum of 14 days.

Limitations of liability

Cat­sand­ber­ries can­not be held respon­si­ble for any direct or indi­rect dam­age caused to your equip­ment when access­ing the www.development.catsandberries.com (in par­tic­u­lar a break in ser­vice, exter­nal intru­sion or the pres­ence of com­put­er virus­es).
Cat­sand­ber­ries can­not be held respon­si­ble for any omis­sions, inac­cu­ra­cies or short­com­ings in updat­ing, whether these are its fault or the fault of third par­ty part­ners who pro­vide it with this infor­ma­tion.
Hyper­text links may lead to part­ner sites, which are sole­ly respon­si­ble for their con­tent.
All infor­ma­tion pro­vid­ed on this site is giv­en for infor­ma­tion pur­pos­es only and it is sub­ject to mod­i­fi­ca­tions.
The pho­tos attached to the prod­ucts are not bind­ing.
Cat­sand­ber­ries doesn’t hold any respon­si­bil­i­ty for any pos­si­ble adverse effects plants offered for sale can cause if con­sumed to peo­ple, cats and oth­er ani­mals.
Cat­sand­ber­ries can­not be held respon­si­ble for dam­ages of any kind, whether mate­r­i­al, imma­te­r­i­al or phys­i­cal, which may result from the mal­func­tion or mis­use of the prod­ucts sold.
No “growth guar­an­ty” can be giv­en for the plants offered for sale.

Intellectual property rights

All ele­ments on this site are the exclu­sive intel­lec­tu­al prop­er­ty of Cat­sand­ber­ries.
Cat­sand­ber­ries is the own­er of intel­lec­tu­al prop­er­ty rights and holds the rights of use on all the ele­ments acces­si­ble on the web­site, in par­tic­u­lar the arti­cles, images, graph­ics, logos, videos, icons and sounds.
Any repro­duc­tion, rep­re­sen­ta­tion, mod­i­fi­ca­tion, pub­li­ca­tion or adap­ta­tion of all or part of the ele­ments of the site, what­ev­er the means or process used, is pro­hib­it­ed, except with the pri­or writ­ten autho­riza­tion of Cat­sand­ber­ries.

These terms and con­di­tions of sale are sub­ject to Bel­gian law. In the event of a dis­pute, the courts of Antwerp shall have exclu­sive juris­dic­tion.
